Works related to construction falls under the OHS Authority Act – Legal notice 88 of 2018. These works include excavations, earthworks, tunnels, laying of foundations for all types of buildings or structures, building, construction, assembly and disassembly of prefabricated elements, structural alteration, conversion or fitting-out, renovation or restoration, alterations, repairs, demolition, dismantling, upkeep, maintenance, painting work, cleaning work and drainage.

Legal Notice 88 of 2018 lays down the minimum health and safety requirements for such work which must be followed by all stakeholders mostly the “Client”.

Who is the “Client”? and what are the main client’s obligations?

The term “Client” means any person for whom the mentioned works are being or to be carried out.

One of the main obligation is to appoint a health and safety (HS) project supervisor both for the design and construction stage. Such HS project supervisor/s shall prepare the HS plan and file which includes relative documentation and coordination of the implementation of the general principles of prevention, management of Health and safety throughout the works, makes recommendations to the client to ensure the health and safety of the workers and those who may be effected by the works, ensure that the contractors, self-employed and workers are abiding by the safety control measures and in line with the legislation, and organize cooperation between contractors.

Submit the Construction notification form to the OHS Authority if works are scheduled to exceed five hundred (500) person-days. This should be submitted at least four calendar weeks before commencing works.
